The above referenced puppy is being sold to the buyer(s) in good health and has been thoroughly examined by a licensed veterinarian with proper shots and worming. Seller certifies that said puppy is in good health to the best of Seller's knowledge. The Puppy is being sold to buyers with LIMITED AKC registration. Payment in full must be received before buyer may take ownership over puppy.
Initial Health Exam: If within 5 days of transfer, the puppy is found to have a life-threatening illness the buyer may return this puppy to the seller at the buyer’s expense to receive a full refund of this puppy. Proof of examination and diagnosis must be provided to the seller within the five day period in order to receive any reimbursement of funds. The seller reserves the right to a second veterinary opinion.
Buyer has 5 days from the purchase to return the puppy for ANY reason and will receive a full refund (minus $300 holding fee) provided puppy is returned to seller in good health and condition, as delivered.
The seller will provide the buyer with the puppies vaccine and worming records at the time of pick up. The seller is not liable for any accident or injury of the animal once it leaves the sellers premises. The seller is not responsible for illness due to the ingestion of foreign objects, food, chemicals, stress related issues or physical injury.
If for any reason throughout the dogs life, the buyer(s) can no longer care for dog, the seller agrees to accept the dog back. However, the buyer will not receive a refund of any kind.
SELLER guarantees against any genetic defects until 24 months of age. For Hip Dysplasia: you must have official written documentation including films and any and all veterinary reports associated with the hip dysplasia diagnosis from the OFA (Orthopedic Foundation for Animals) or PennHIP of bilateral dysplasia before a replacement puppy is given. We will not honor a written statement or exams from your licensed vet, it must be documented by OFA or PennHIP and the results must be sent to our vet. For genetic eye defects: You must have official written documentation from CERF stating that the dog/puppy has a genetic abnormality.
If your puppy is diagnosed with a genetic defect, we do NOT require the puppy be returned to us, however will accept puppy back if desired by buyer. If genetic defect is diagnosed, buyer will receive a replacement puppy from the first available litter.
The SELLER states that the Dam and Sire of this litter have been tested for common genetic abnormalities of this breed, as recommended by the orthopedic foundation for animals. The Dam and Sire have had their hearing tested by BAER, Hips by PENNHIP, eyes by CERF and patellas by our family veterinarian. These results will be provided to BUYER at time pick up per request.
The Seller does not guarantee against any non genetic faults that occur and do not threaten the health or well being of the puppy ( hypoglycemia, bad bites, umbilical hernias, allergies, undescended testicles, luxating patellas from trauma, etc .... ).
The Havanese breed is known to change substantially in the coloring of their coat over time; therefore the color of your puppy cannot be guaranteed.
The Havanese Club of America advises that Havanese are sensitive to the Leptosporosis vaccine, and in several cases reactions have been fatal to puppy's and dogs. The Havanese Club of America Vaccine Guidelines recommend that the Leptosporosis Vaccine not be administered to Havanese. The Seller shall be released from any and all liability related to vaccine reactions, illness or fatality caused by the administration of the Leptosporosis vaccine. Administration of this vaccine to your puppy/dog voids the Health Guarantee provided by the Seller in this contract. Documentation from the Havanese Club of America regarding this will be provided upon pick up of puppy.
The buyer agrees to provide proper veterinary care to puppy. The buyer agrees to keep puppy as an indoor pet. If the buyer can no longer keep the dog inside, the seller agrees to take the dog back, the buyer will not receive a refund.
The buyer agrees to have the puppy spayed/neutered at the appropriate age (6-9 months).
Hypoglycemia is a disorder caused by low blood sugar and occurs when the puppy misses a meal and has the stress of a new home. Make sure your puppy always has food and water available and is getting enough rest. I recommend adding a little water to their food to soften it, and help your puppy make the transition to your home.
This agreement is hereby entered into and wholly executed in the State of Pennsylvania and any litigation arising from any possible breach of this agreement shall be adjudicated in the County of Westmoreland in the State/Commonwealth of Pennsylvania, under Pennsylvania law. All parties hereby submit themselves to the jurisdiction of said courts. Should any provision of this agreement be held invalid, illegal or unenforceable, the remaining provisions of this contract will not be affected.
I/We fully understand the terms of this contract and acknowledge that it is a binding contract. By signing this contract I/We agree to abide by its terms and conditions.
